COOPERS TRAVEL PTY. LTD. – TERMS & CONDITIONS

PRICING: Prices quoted are in Australian dollars unless otherwise stipulated. Prices may be subject to change based on availability and can be withdrawn or changed without notice. The price is generally only guaranteed when paid in full. However, in certain circumstances, prices may still change due to matters outside our control.

SERVICE PROVIDERS: Coopers Travel act as an agent and sells products on behalf of accommodation, transport, and other providers such as airlines, rail, coach and cruise line operators. We are not a travel provider and as such whilst we exercise care, we have no control over or liability for the services provided by the third parties. Airlines, Cruise Lines, and third-party providers all impose different terms and conditions to the ones imposed by Coopers Travel. Clients should ensure they read these terms and conditions before finalising travel bookings. Coopers Travel can assist you in finding the Terms & Conditions related to your specific travel plans. Ultimately it is your responsibility to ensure you are aware of the relevant terms and conditions related to your travel booking. Brochures distributed are not ours but are supplied by the service providers and we accept no liability for errors in that material. If for any reason the services paid to the travel provider are unable to be provided, your redress lies with the provider for said services.

COOPERS TRAVEL SERVICE: This is to arrange and coordinate the service offered by third-party service providers and arrange a contractual relationship between you and the provider. We may receive fees, commissions, gifts, or financial incentives from third parties under these contracts. In the event, that Coopers Travel is responsible for a mistake in the organization of your travel plans, upon proof of this dispute, Coopers Travel will make every endeavour to rectify and reach an amicable agreement over any such error. Coopers Travel strongly advises all passengers should be up to date with current vaccination requirements in relation to COVID-19, and Coopers Travel accepts no responsibility for unvaccinated passengers when travel restrictions/bans are imposed by airlines, tour wholesalers/suppliers and any such services beyond our control.

CANCELLATIONS, CHANGES & REFUNDS: Cancelled bookings may incur cancellation fees by suppliers that may be up to 100% of the cost of the booking. Some tickets are non-refundable or transferrable. Any amendments and changes to bookings that incur fees by the suppliers will be at the clients’ cost. Coopers Travel will charge amendment fees of $ 55.00 per person for any tickets or documents to be reissued, amended, or cancelled. Further cancellation fees of up to 15% of the total booking price may be incurred in addition to any other charges incurred by airlines, wholesalers etc. Any refund for cancelled bookings will not be paid until the supplier provides Coopers Travel with the refund, at which time please allow 7 working days for the refund to be processed to you. Coopers Travel are not responsible for supplier delays in issuing refunds. There are numerous rules and regulations in relation to advance purchase and other discounted airfares which involve substantial cancellation or amendment fees and there may be no refund on cancellations or amendments.

DEPOSITS & FINAL PAYMENTS: Deposits, along with Coopers Travel Booking and Administration fee are required for confirmation of booking. Once your deposit monies have been paid you are deemed to have accepted the full terms and conditions of contracts. Your consultant will advise how much you will need to pay and advise when further monies and final payments are due. In some instances, full payment is required at the time of booking. Please note most deposits are non-refundable, additionally, Coopers Travel service fee is non-refundable. Please enquire for full Terms & Conditions related to wholesalers providing your travel services. Failure to pay deposits and final monies on time may result in cancellation of travel plans.

TRAVEL DOCUMENTS: Please ensure we have the correct spelling of your name as per your Passport/Drivers Licence. You may be denied travel if your identification papers do not match your travel documents. Should your name not be identical to your Passport/Licence, additional fees will apply to have tickets and vouchers re-issued. It is your responsibility to review all travel documents and immediately advise of errors in names, dates, or timings. It is the customer’s responsibility to advise consultants of frequent flyer requests, we do not accept responsibility for any inability to claim points. It is also your responsibility to discuss any special requirements with your travel consultant i.e. seating, meal requests etc. Please note as you are accepting this document on behalf of all parties travelling, it is deemed your responsibility to pass this information on. It is your responsibility to re-confirm outbound and inbound flights and times. Whilst every attempt is made to update clients of amended flight time/changes notifications, we are not responsible for amended flight time changes/charges and bear no responsibility for changes and charges to travel due to severe weather or disasters that prevent scheduled arrangements from occurring for flights/cruises etc.

TRAVEL INSURANCE: Travel Insurance is strongly recommended for all travel arrangements. We would be happy to forward you a brochure/quote which outlines all conditions/exclusions applicable to the policy. Should you decide to decline insurance you may be asked to sign a disclaimer. Ultimately travel insurance is your own responsibility, but we urge all clients to ensure they are covered for any unforeseen circumstances that may arise. Clients should read and fully understand the Product Disclosure Statement issued by the Provider and seek an Emergency Assistance phone number to carry with them.

PASSPORTS & VISAS: A current Passport is required by all International travellers and we will require a copy of your current Passport for your file. Please discuss with your consultant if visas are required for any of the countries you are visiting. It is ultimately your RESPONSIBILITY to apply for these visas, you may wish to liaise with your consultant who can assist you with obtaining these. It is your RESPONSIBILITY to ensure all passports are valid with at least 6 months validity on entry back into Australia. If travelling on a foreign passport it is your RESPONSIBILITY to ensure all re-entry permits required by Australian Immigration are valid. In the event that you are travelling to a country or countries which do not require a visa for Australian passport holders, you must tell us if you have been arrested or convicted in respect of any offence or breach of law. Non-disclosure of this information may lead to your being refused entry on arrival in certain countries. In that event, we take no responsibility whatsoever. If you do not wish to disclose such information to us, then you must contact the embassy of each country of destination and make your own arrangements, regarding entry to that country. TAXES & EXCESS LUGGAGE: There may be further taxes payable at some airports and in some instances taxes to some hotels are required to be paid directly. There may be further taxes, fees and insurances payable at car rental agencies upon collection.

Excess Baggage charges are the travellers’ responsibility.

HEALTH: It is recommended that you check with your local doctor with regard to your general health and fitness for travel, and for any vaccinations which may be required for the countries and areas which you plan to travel to. Should appropriate vaccinations and precautions not be taken you may be denied access to a country. It is your responsibility to Register with DFAT for emergencies and to keep yourself up to date with any Travel Advices by checking the following Internet Page: <http://www.smartraveller.gov.au>

AUSTRALIAN GOVERNMENT TRAVEL ADVICE: The Department of Foreign Affairs issues ‘Travel Advice’ for the benefit of all international travellers. Coopers Travel recommends that all clients consult these notices BEFORE FINALISING

ARRANGEMENTS TO TRAVEL. Travel Advice notices are currently issued for a wide range of countries. Foreign Affairs Travel Advice notices can be accessed via the Internet at www.dfat.gov.au or by phoning the 24hr Consular Emergency Centre on +61 2 6261 3305 or local call cost within Australia, 1300 555 135.

LIMITATION OF LIABILITY: Subject to Australian Consumer Law, Coopers Travel does not accept any liability in contract, tort or otherwise for any injury, damage, loss, delay, additional expense or inconvenience caused by suppliers or third-party providers over whom we have no direct control.

FORCE MAJEURE: Coopers Travel is not liable for force majeure or any other event which is beyond our control, or for which is not preventable by our agency, the customer will be bound by the supplier’s terms & conditions. Neither party will be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, outbreaks of infectious disease or any other public health crises, civil commotion, breakdown of communication facilities, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy. For avoidance of doubt, Force Majeure shall not include (financial distress nor the inability of either party to make a profit or avoid a financial loss, (b) changes in market prices or conditions, or (c) a party’s financial inability to perform its obligations hereunder.

CONFIDENTIALITY & PRIVACY: We acknowledge that, in addition to our duties we have a general duty of confidentiality towards you except in the following circumstance.

1. Where we are required by law to disclose information about you.

2. Where you give us express and implied consent to disclose that information.

3. In the event that an accident, disaster or emergency is reported to have occurred in a country where I/we will or may be travelling, I/we authorize you to disclose to the Australian Government Department of Foreign Affairs and Trade details of my/our itinerary (including without limitation, transport and accommodation arrangements) and my/our contact details within Australia and overseas.
